These Terms & Conditions ("Terms") govern your access to and use of the Walem mobile apps, website, and related services (the "Services"), operated by Walem ("Walem", "we", "us"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders or reservations. By using the Services you confirm that you meet this requirement.
2. The Service
Walem is a platform that connects diners with participating restaurants. Through Walem you can pre-order meals and reserve tables. Walem itself does not prepare food or operate restaurants; the contract for any meal or table is between you and the restaurant. We facilitate the order, reservation, and (where offered) payment.
3. Your account
- You are responsible for the accuracy of the information you provide.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- Notify us immediately of any unauthorized use at support@walem.app.
4. Orders, reservations & pricing
- Menu items, availability, and prices are set by the restaurants and may change.
- When you place a pre-order or reservation, you make an offer that the restaurant may accept or decline.
- Applicable taxes and any service fees will be shown before you confirm.
- You are responsible for arriving on time for reservations and for collecting or being present for pre-orders.
5. Cancellations, no-shows & refunds
Cancellation and refund eligibility depend on the restaurant's policy and the timing of your request, shown at the time of booking. Repeated no-shows may lead to restrictions on your account. For refund help, contact support@walem.app.
6. Payments
Payments are processed by third-party payment providers. By paying through the Services, you authorize the charge for your order, applicable taxes, and fees. We do not store full card details on our servers.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful or fraudulent purpose.
- Place false or abusive orders or reservations.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services.
- Reverse engineer, copy, or resell any part of the Services except as permitted by law.
- Post unlawful, defamatory, or infringing content in reviews or messages.
8. Restaurant partners
Restaurants using the Walem restaurant app agree to additional partner terms covering menus, pricing accuracy, order fulfilment, and conduct. Restaurants are solely responsible for the food, service, and legal compliance (including food safety) at their venues.
9. Intellectual property
The Services, including software, design, logos, and content (excluding restaurant content), are owned by Walem and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free, or that any restaurant, menu item, or reservation slot will be available.
11. Limitation of liability
To the maximum extent permitted by law, Walem will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim is limited to the amount you paid through the Services in the three months before the claim.
12. Indemnity
You agree to indemnify and hold harmless Walem from claims, damages, and expenses arising from your misuse of the Services or breach of these Terms.
13. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Services in a way that harms others or us.
14. Governing law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-laws rules. Disputes will be subject to the competent courts of that jurisdiction, unless mandatory local law provides otherwise.
15. Apple App Store — additional terms
If you download the app from the Apple App Store, the following also applies:
- These Terms are between you and Walem only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app; any warranty claims are our responsibility.
- Apple is not responsible for addressing any claims relating to the app, including product liability, legal/regulatory compliance, or consumer protection claims.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
- Apple is not responsible for any third-party claim that the app or your use of it infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted here with a new "Last updated" date. Continued use of the Services after changes means you accept the updated Terms.

تحكم هذه الشروط والأحكام («الشروط») وصولك إلى تطبيقات والم وموقعها والخدمات المرتبطة بها (الـ«الخدمات») واستخدامك لها، والتي تديرها والم («والم» أو «نحن»). بإنشائك حسابًا أو استخدامك للخدمات، فإنك توافق على هذه الشروط. إذا كنت لا توافق، فلا تستخدم الخدمات.
1. الأهلية
يجب أن يكون عمرك 18 عامًا على الأقل، أو سنّ الرشد في بلدك، لإنشاء حساب وتقديم الطلبات أو الحجوزات. باستخدامك للخدمات، تؤكّد أنك تستوفي هذا الشرط.
2. الخدمة
والم منصّة تربط الضيوف بالمطاعم المشاركة. من خلال والم يمكنك الطلب المسبق للوجبات وحجز الطاولات. ولا تقوم والم بنفسها بإعداد الطعام أو تشغيل المطاعم؛ فالعقد الخاص بأي وجبة أو طاولة يكون بينك وبين المطعم. ونحن نُيسّر الطلب والحجز والدفع (حيثما كان متاحًا).
3. حسابك
- أنت مسؤول عن دقة المعلومات التي تقدّمها.
- أنت مسؤول عن سرّية بيانات الدخول وعن جميع الأنشطة التي تتم عبر حسابك.
- أبلِغنا فورًا بأي استخدام غير مصرّح به عبر support@walem.app.
4. الطلبات والحجوزات والأسعار
- أصناف القائمة والتوفّر والأسعار تحدّدها المطاعم وقد تتغيّر.
- عند تقديمك طلبًا مسبقًا أو حجزًا، فإنك تقدّم عرضًا يجوز للمطعم قبوله أو رفضه.
- تُعرض الضرائب المطبّقة وأي رسوم خدمة قبل تأكيدك.
- أنت مسؤول عن الوصول في الوقت المحدّد للحجوزات وعن استلام الطلبات المسبقة أو التواجد لها.
5. الإلغاء والغياب والاسترداد
تعتمد أهلية الإلغاء والاسترداد على سياسة المطعم وتوقيت طلبك، وتظهر عند الحجز. وقد يؤدي تكرار الغياب إلى فرض قيود على حسابك. للمساعدة في الاسترداد، تواصل عبر support@walem.app.
6. المدفوعات
تُعالَج المدفوعات عبر مزوّدي دفع خارجيين. بدفعك من خلال الخدمات، فإنك تصرّح بخصم قيمة طلبك والضرائب والرسوم المطبّقة. ولا نخزّن تفاصيل البطاقة كاملةً على خوادمنا.
7. الاستخدام المقبول
توافق على عدم:
- استخدام الخدمات لأي غرض غير قانوني أو احتيالي.
- تقديم طلبات أو حجوزات كاذبة أو مسيئة.
- التشويش على الخدمات أو تعطيلها أو محاولة الوصول غير المصرّح به إليها.
- إجراء هندسة عكسية لأي جزء من الخدمات أو نسخه أو إعادة بيعه إلا بما يسمح به القانون.
- نشر محتوى غير قانوني أو تشهيري أو منتهِك في التقييمات أو الرسائل.
8. المطاعم الشريكة
توافق المطاعم التي تستخدم تطبيق والم للمطاعم على شروط شراكة إضافية تشمل القوائم ودقة الأسعار وتنفيذ الطلبات والسلوك. والمطاعم وحدها مسؤولة عن الطعام والخدمة والامتثال القانوني (بما في ذلك سلامة الغذاء) في منشآتها.
9. الملكية الفكرية
الخدمات، بما في ذلك البرمجيات والتصميم والشعارات والمحتوى (باستثناء محتوى المطاعم)، مملوكة لوالم ومحميّة بموجب القانون. ونمنحك ترخيصًا محدودًا وغير حصري وغير قابل للنقل وقابلًا للإلغاء لاستخدام الخدمات للغرض المقصود منها.
10. إخلاء المسؤولية
تُقدَّم الخدمات «كما هي» و«حسب توفّرها» دون أي ضمانات من أي نوع، إلى أقصى حدّ يسمح به القانون. ولا نضمن أن تكون الخدمات دون انقطاع أو خالية من الأخطاء، أو أن يكون أي مطعم أو صنف أو موعد حجز متاحًا.
11. تحديد المسؤولية
إلى أقصى حدّ يسمح به القانون، لن تتحمّل والم المسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو تأديبية، أو عن خسارة الأرباح أو البيانات أو السمعة الناشئة عن استخدامك للخدمات. وتقتصر مسؤوليتنا الإجمالية عن أي مطالبة على المبلغ الذي دفعته عبر الخدمات في الأشهر الثلاثة السابقة للمطالبة.
12. التعويض
توافق على تعويض والم وحمايتها من المطالبات والأضرار والنفقات الناشئة عن إساءة استخدامك للخدمات أو خرقك لهذه الشروط.
13. الإنهاء
يمكنك التوقف عن استخدام الخدمات وحذف حسابك في أي وقت. ويجوز لنا تعليق وصولك أو إنهاؤه إذا خرقت هذه الشروط أو استخدمت الخدمات بطريقة تضرّ بالآخرين أو بنا.
14. القانون الحاكم
تخضع هذه الشروط لأنظمة المملكة العربية السعودية، دون اعتبار لقواعد تنازع القوانين. وتخضع النزاعات للمحاكم المختصة في تلك الولاية القضائية، ما لم ينصّ القانون المحلي الإلزامي على خلاف ذلك.
15. متجر Apple App Store — شروط إضافية
إذا نزّلت التطبيق من متجر Apple App Store، فينطبق أيضًا ما يلي:
- هذه الشروط بينك وبين والم فقط، وليست مع Apple. وApple ليست مسؤولة عن التطبيق أو محتواه.
- ليست على Apple أي التزام بتقديم أي صيانة أو دعم للتطبيق.
- إلى أقصى حدّ يسمح به القانون، لا يقع على Apple أي التزام بالضمان فيما يخص التطبيق؛ وأي مطالبات ضمان هي مسؤوليتنا.
- Apple ليست مسؤولة عن معالجة أي مطالبات تتعلق بالتطبيق، بما في ذلك مسؤولية المنتج أو الامتثال القانوني والتنظيمي أو حماية المستهلك.
- إذا لم يتوافق التطبيق مع أي ضمان مطبّق، يمكنك إخطار Apple، ويجوز لها ردّ سعر الشراء (إن وُجد)؛ وليس عليها أي التزام ضمان آخر.
- Apple ليست مسؤولة عن أي مطالبة من طرف ثالث بأن التطبيق أو استخدامك له ينتهك حقوق الملكية الفكرية.
- تقرّ بأنك لست في دولة خاضعة لحظر من حكومة الولايات المتحدة ولست مدرجًا في أي قائمة أطراف محظورة لدى حكومة الولايات المتحدة.
- تُعدّ Apple وشركاتها التابعة مستفيدين كأطراف ثالثة من هذه الشروط، ويجوز لها إنفاذها بحقّك.
16. تغييرات على هذه الشروط
قد نحدّث هذه الشروط من وقت لآخر. وستُنشر النسخة المحدّثة هنا مع تاريخ «آخر تحديث» جديد. واستمرارك في استخدام الخدمات بعد التغييرات يعني قبولك للشروط المحدّثة.
